Americans With Disabilities Act (ADA) Amendments took effect January 1, 2009. As part of those amendments the Equal Employment Opportunity Commission (EEOC) was charged with the task of issuing new regulations to conform to the amended ADA.
The EEOC has recently issued its proposed new ADA regulations and is now accepting comments from the public. In our view the regulations as proposed are in serious need of revision. Now is the time (really the only time) for employers' interests to be taken into account before the EEOC regulations become final. Act now!
Wessels Sherman intends to submit commentary on the EEOC's proposed ADA regulations and we are seeking input from employers to include with our response.
Our law firm's own James Sherman handled the very first ADA case tried by the EEOC, back in 1993. Thus, Jim has a very keen understanding of the many difficulties posed for employers by this well intended but complex law. The proposed new regulations claim they will simplify things under the ADA; Jim does not see it that way, especially insofar as employers are concerned. The EEOC is now accepting comments on its proposed new ADA regulations. We are asking concerned employers to provide us with their comments and feedback so we can include them in our submission to the EEOC.
