Auditor's Study Indicates that State Agencies and Contractors Are Not Fully Complying With Minnesota's E-Verify Requirements

August 2009

By: Kevin M. Mosher

Similar to the federal Executive Order, which will require certain federal contractors to enroll and use E-Verify (delayed four times, now set to be effective on September 8, 2009), in 2008 Minnesota's governor issued an Executive Order requiring certain government contractors and agencies to use the E-Verify system. However, based on a report prepared by the Legislative Auditor's office and issued in June, certain government agencies are not complying with the Order, nor are an estimated 40% of the private government contractors covered by the Order. Based on the results of the report, and the subsequent outrage over the significant percentage of non-compliance and questions of the lack of oversight of private contractors' E-Verify compliance, discussions are underway about increasing the agencies' enforcement for this Executive Order.
